After hearing the matter for some time, it transpires that charges have been framed on 10th October 2023, but no witness is examined till date. The Applicant has been in custody for the past five years. Mr. Kiran Shinde, learned APP, on instructions, states that the prosecution intends to examine only 18 witnesses.

In the meantime, the Trial Court is directed to record the deposition of the victim within the next four weeks from the date on which a copy of this order is placed before the Trial Court.

Ms. Aneesa Cheema, learned Counsel appointed through Legal Aid Services and appearing for Respondent No. 2, submits that the advocate of the Applicant has not been appearing before the Trial Court for the past several dates. The Applicant is directed to cooperate with the conduct of the trial.
