This is an Application under Section 439 of the Code of Criminal Procedure 1973 seeking Regular Bail in connection with C.R.No.85 of 2023 registered with Nirmal Nagar Police Station, Mumbai for the offences punishable under Sections 302, 324, 323, 504 read with 34 of the Indian Penal Code, 1860.

Mr. Naik, learned Advocate would persuade me to consider the FIR and would argue that role of the Applicant is with respect to administering and inflicting fist blows on the victim. He would submit
76.BA.2608.24.doc that Accused No.1 is the elder brother of Applicant and he has used the weapon in question namely knife to inflict 4 fatal stab injuries on the victim.
He would submit that Applicant has no antecedents and he is incarcerated for the past 1 year. Therefore he has persuade me to consider the case of the Applicant for bail on the aforesaid ground. 5.
Ms. Bajoria, learned APP shall take appropriate instructions and apprise the Court about the specific role of the Applicant in the present crime on the next adjourned date upon which the Court shall consider the case of the Applicant further.
