2. By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.766 of 2023, registered with Sinnar Police Station, District: Nashik for the offences punishable under Sections 363, 364-A, 120-B, 392, 384, 342, 386, 323, 504, 506 read with Section 34 of the Indian Penal Code, Sections 3/25 of the Indian Arms Act, 1959.
3. Having gone through the charge-sheet and the relevant material collected by the Investigating Officer, during investigation, it is RRaut
17-BA2646-2024.doc evident that the statement of the victim was recorded wherein he has narrated the complete incident of the alleged kidnapping. Furthermore, the statement of Manager of the Lodge where the accused had taken the victim and stayed is also prima-facie, show the complicity of the applicant in the alleged offence. Moreover, from the material collected by the Investigating Officer, it can be gathered that the applicant made payment of the said lodge through his Google Pay Account.
4. Thus, considering that sufficient incriminating material against the applicant, which prima-facie shows his complicity in the alleged offence and as the offence is serious, I am not inclined to grant bail. Hence, the application is rejected.
5. The applicant is at liberty to move an application afresh before the trial Court after nine months if there is no progress in the trial.
