By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.342 of 2023 registered with Sadar Bazar Police Station, Solapur City for the offences punishable under Sections 420, 419, 465, 467, 468, 471 r/w 34 of Indian Penal Code.

In the present matter during investigation it was revealed that the Applicant has received Rs.8,64,314/- in his account from the MANISH SURESHRAO THATTE Date: 2024.10.17 17:25:47 +0530 MANISH SURESHRAO THATTE total amount involved in the present matter. Out of the said amount the Applicant has handed over Rs.7,00,000/- to the police and before he could hand over remaining amount of Rs.1,64,314/- he was

2 of 3 918.BA.2672.2024.doc arrested. Applicant is still ready to deposit amount of Rs.1,64,314/- to the police.

From the above referred facts it is evident that substantive amount has already been recovered and as far as balance amount is concerned the Applicant is ready to pay the same. In the above referred backdrop as the charge sheet has been filed and all the relevant material and documents are in the custody of police, I am of the opinion that further custody of Applicant is not required. Hence, I pass following order :

ORDER

(i) Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.342 of 2023 registered with Sadar Bazar Police Station, Solapur City for the offences punishable under Sections 420, 419, 465, 467, 468, 471 r/w 34 of Indian Penal Code on furnishing P.R.Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount;

(iii) The Applicant shall attend Sadar Bazar Police Station, Solapur, on every 1st and 16th of every month between 10.00 a.m and 11.00 a.m till conclusion of trial, except on the date of trial; (iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; (v) Liberty is granted to the State for cancellation of bail if the applicant breaches any condition or misuses the liberty or commits

(vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
