Heard Ms. Ansari, learned Advocate for Applicant; Ms. Ganapathy, learned APP for Respondent No.1 and Mr. Karnik, learned Advocate for Respondent No.2.

Applicant in the present case is 29 years old whereas prosecutrix is 19 years old at the time of incident. Prima facie, from the record it is borne out that both of them had developed a friendship and relationship.

However Mr. Karnik would submit that he needs to take specific instructions from the legal guardian / prosecutrix in question, so that he will be in a better position to apprise the Court about the same.

Ms. Ganapathy, learned APP is directed to ask the concerned

35.BA.2695.2024.doc Investigating Officer to forward details of the appointed Advocate to Respondent No.2 so that appropriate instructions can be obtained by the appointed Advocate. Let the aforesaid exercise be carried out within a period of one week from today.
