2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No. 163 of 2024 registered with Mahalunge MIDC Police Station, for the offences punishable under Sections 394 and 504 read with Section 34 of the Indian Penal Code, 1860, Section 3/25 of the Arms Act, 1959 and Section 7 of Criminal Law (Amendment) Act, 2013. 3) Having gone through the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, it is evident that when the offence was committed by the applicant, he was being externed from the Pune District and in breach of it he entered into Pune District and committed the alleged offence. 1/2
36-BA-2698-24.DOC 4) Furthermore, there are seven antecedents against the applicant of a similar nature, which shows that the applicant is a habitual offender. Moreover, there is sufficient incriminating material collected against the applicant during the investigation.
5) In the circumstances, since there is every likelihood that if the applicant is released on bail, he may commit similar offence, I am not inclined to grant bail to the applicant. Accordingly, the application is rejected and disposed of.
