Heard Ms. Shaikh, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State.

In the present case, Applicant is indicted in an offence punishable under the provisions of Indian Penal Code, 1860; Drugs and Cosmetics Act and NDPS Act. Applicant is incarcerated in the present crime for more than 2 years and 7 months pending trial. 3.

Ms. Shaikh, learned Advocate for Applicant would persuade the Court to consider the fact that Applicant has no role whatsoever to play but he was merely standing next to the Accused Nos.2 and 3 and they are not charge-sheeted, but merely on the basis of their statements, Applicant has been indicted.

Mr. Dedhia, learned APP shall ascertain the complicity of the Applicant on the basis of his role from the charge-sheet and accordingly apprise the same to the Court on the next adjourned date. 5.

Considering the long incarceration of the Applicant for more than 2 years and 7 months, present Application shall be heard and decided by the Court on the next adjourned date which shall be noted by the prosecution.

List the Bail Application on Board on 22nd April, 2025. To be placed on the 'Supplementary Board'.
