Heard Ms. Shaikh, learned Advocate for Applicant and Ms. Ganapathy, learned APP for State.

In view of directions contained in paragraph No.3 of the order dated 28th March, 2025 it is informed by the learned Prosecutor appearing in the matter that the relevant panchanama in which Applicant has been arrested has not been annexed to the Application. She would persuade the Court to consider the said panchanama which is present in the prosecution record and it is dated 26.08.2022. She would submit that as delineated in the previous order it is not true that Applicant was a mere bystander and was arrested only because he was found standing next to the other co-accused persons who are arrested alongwith the alleged contraband as stated in the previous

919_BA_2708_2024.docx order. Said panchanama is directed to be placed on record and copy of the same shall be given to the learned Advocate for Applicant forthwith.

In view of request made by Ms. Shaikh to consider the fact that Applicant is in prison for more than past 2 years and 7 months pending trial and charge not being framed, liberty is granted to Applicant to move the vacation Court, if so desired. 4.
