By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 139 of 2023 registered with Shirgaon Parandwadi Police Station, Pimpri-Chinchwad for the offences punishable under Section 376(2) of the Indian Penal Code, 1860 ("IPC" for short) and Sections 3, 4, 5(L) and 6 of the Protection of Children from Sexual Offences Act, 2012 ("POCSO Act" for short).

Mr. Arjun Sethi, learned Advocate for the Applicant submits that the abovesaid crime is now registered as Sessions Case No. 54 of 2023 and is pending on the file of Additional Sessions Judge, Vadgaon, District-Pune.

On 16th June 2025, the following order is passed by this Court :- "1.

Heard Mr. Arjun Sethi, learned Advocate for the Applicant. Mr. S. S. Bedekar, learned Advocate for the informant. Ms. Anamika Malhotra, learned APP for the State.

By the present application, Applicant is seeking bail in connection with C. R. No.139 of 2023 registered with Shirgaon Parandwadi Police Station for the offences punishable under Section 376(2) of IPC and Section 3, 4, 5(L), and 6 of the Protection of Children From Sexual Offence Act, 2012.

Ms. Anamika Malhotra, leaned APP for the State, submits that the Trial has substantially proceeded and the matter is presently at the stage of statement under Section 313 of Cr.PC (Section 351 of BNSS). She submits that the entire matter would be disposed off in a short span of time, as such the present application ought not to be considered.

Learned Advocate for the Applicant sought a pass over to take instructions from the Applicant and the Advocate on record. Learned Advocate for the Applicant states that his senior is in personal difficulty, and therefore, prays time to argue the matter. He requests for and adjournment till 07.07.2025.

At the request of the learned Advocate for the Applicant, list the matter on 7th July, 2025."

Mr. Arjun Sethi, learned Advocate submits that he has instructions from the Applicant to unconditionally withdraw the present Bail Application. Leave granted.

In view of the above, Criminal Bail Application No. 2714 of 2024 is dismissed as withdrawn.
