By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.385 of 2021, registered with Chikali Police Station, Pune for the offences punishable under Sections 302, 396, 347, 452 120(b) r/w 34 of the Indian Penal Code.

This Court vide order dated 29th August 2023 passed in Bail Application No. 266 of 2023 granted bail to the co-accused Raeesudddin Raien whose role is similar with the role of the present applicant and this fact has not been denied by the learned APP. 4.
In that view of the matter as principles of parity is
applicable to the applicant, the application is allowed:
ORDER
i) Criminal application is allowed;
ii) It is directed that the applicant shall be released on bail in Crime No.385 of 2021, registered with Chikali Police Station, Pune for the offences punishable under Sections 302, 396, 347, 452 120(b) r/w 34 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Twenty-Five Thousand with one or more local sureties in the like amount;
iii) The applicant shall attend the Investigating Officer of Chikali Police Station, Pune, once in a month every first Monday of the month between 11.00a.m. and 1.00p.m. iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing the facts to Court or any Police Officer. The applicant shall not taper with evidence.
v) On being released on bail, the applicant shall furnish his contact number and residential address to the Investigating Officer and shall keep him updated, in case there is any change.
vi) The applicant shall not leave the State of Maharashtra without permission of the trial Court; vii) The applicant shall attend the trial regularly. 5.
The application is disposed of .
