This bail application arises out of letter dated 10th June 2024 addressed by the applicant/accused from jail. The FIR in the present case appears to have been registered in the year 2016. Offences under Sections 376 and 506 of the Indian Penal Code, 1860 (IPC) and offences under the provisions of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) have been registered. It is not clear from the letter as to when the applicant was arrested and for how long he has suffered incarceration and further as to what is the stage of the proceedings before the concerned Court.

In view of the above, the learned APP is directed to obtain a copy of charge-sheet for perusal of this Court on the next date. The learned APP shall also take instructions about the status of the proceedings before the concerned Court.

Since, offences under the POCSO Act are registered, the Investigating Officer is directed to inform the victim about the pendency of this application, within one week from today and submit proof thereof before this Court.

If the victim, upon being made aware about the pendency of this application, desires to have legal-aid service, she shall be provided legal aid by the High Court Legal Services Committee. 5.
Equally, since the applicant/accused has moved this Court through jail, the High Court Legal Services Committee is directed to appoint an advocate from its panel forthwith, to represent the applicant. The advocate so appointed by the High Court Legal Services Committee will contact the learned APP for copy of the charge-sheet and other relevant documents.

List the application for further consideration on 23rd September 2024 (High on Board).
