Heard learned counsel for the Applicant and learned APP for the State.

By this Application, the Applicant is seeking regular bail in Crime No.592 of 2023 registered with Kondhwa Police Station, Dist Pune for the offences punishable under Sections 307, 323, 504 and 34 of the Indian Penal Code, 1860 (for short 'IPC'), under Section 7 of Criminal Law Amendment, under Section 37(1) and 135 of Maharashtra Police Act. 3.

It is prosecution's case that on 09/06/2023 about 2.45 p.m. Applicant and co-accused assaulted the son of the first informant with wooden stick of shovel and roof tiles with intention to kill him as Applicant and co-accused demanded money from the injured for party and he

refused to give money.

It is contention of learned counsel for the Applicant that Applicant is behind bars for more than 2 years and 9 months, yet charge is not framed. It will take time to conclude the trial and requested to allow the application.

It is contention of learned APP that Applicant has antecedents. He injured the son of the first informant with intention to kill him. There are specific allegations against the Applicant. If Applicant is released on bail, he may abscond or threaten the prosecution witnesses and requested to reject the application.

I have heard both learned counsel, perused the chargesheet and documents produced on record.

Applicant is behind bars for more than 2 years and 9 months, yet charge is not framed. It may take time to conclude the trial. There are 33 prosecution witnesses to be examined.

Considering these facts, I pass the following order (i) The Applicant- Dinesh Ramdas Ghadage be released on bail in Crime No.592 of 2023 registered with Kondhwa Police Station, Dist Pune , on furnishing PR bond of Rs.25,000/- with one or two solvent sureties in the like amount.

(ii) The Applicant shall not tamper with the evidence and/or

influence the prosecution witnesses.

(iii) Applicant shall not enter in Pune City till recording evidence of the first informant as well as injured.

(iv) The Applicant shall inform his latest place of residence and mobile number immediately after being released and/or change of residence or mobile details, if any, from time to time to the Investigating Officer.

(v) The Trial Court shall decide the case on its own merits and in accordance with law, uninfluenced by the observations made in this order. (vi) The Applicant shall attend the concerned police station as and when called and cooperate with the investigating officer. (vii) Bail Application is allowed in the aforesaid terms.
