By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.4 of 2021, registered with Bhunj Police Station, Satara, for the offences punishable under Sections 302, 307, 364, 120-B, 396, 201 r/w 34 of the Indian Penal Code, 1860 and Sections 3(1)(ii), 3(2) and 3(4) of the Maharashtra Control of Organised Crime Act, (MCOC), Act. 3.

Having gone through the charge-sheet and the relevant material collected by the IO during the investigation, it is evident that there is ample incriminating material against the applicant. There are eyewitnesses to the incident and one of the witnesses is the employee varsha

920-ba-2762-2024.doc of the applicant who narrated the complete story of the offence and also the involvement of the applicant in the alleged offence. The spot of incident i.e. poultry farm, is owned by the applicant and his own staff narrated incident and attributed a specific role to the applicant. The offence is very serious and further the provisions of MCOC have been invoked. The deceased was brutally murdered, and his body was disposed of by the accused persons.

In the circumstances, considering the incriminating material available against the applicant, I am of the opinion that this is not a fit case for grant of bail.
