2) By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No. 18 of 2024 registered with Mhasrul Police Station, Nashik, for the offences punishable under Sections 307, 120-B, 326, 452, 323 and 506 read with Section 34 of the Indian Penal Code, 1860 and Sections 11(d)(g) and (z) of the Prevention of Cruelty to Animals Act, 1960. 3) Having gone through the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, particularly WhatsApp app chats and the conversation between the applicant and the co-accused, the complicity of the applicant in the 1/2

957-BA-2824-24.DOC alleged offence is prima facie apparent. Thus, there is sufficient incriminating material to show the complicity of the applicant in the alleged offence. Therefore, a submission of the learned Counsel for the applicant that the applicant was not present when the incident took place, is immaterial when the allegations are about the conspiracy. 4) Since the offence is serious and there is sufficient material available on record, at this stage, I am not inclined to grant bail.
