This is the second Bail Application by the Applicant, the first being rejected on merits on 09/07/2021, where it is specifically recorded that the prosecution has framed the Applicant on the basis of last seen theory and, in the wake of the material, in the charge-sheet clearly pointing towards the guilt of the Applicant.
On reading of the charge-sheet, I formed a prima facie opinion, that it was only the Applicant, who can be responsible for the death and on this ground, the Application was rejected. 2.
The second Bail Application filed in the year 2024 is reiteration of earlier grounds, claiming innocence and one another ground, which is pressed into service, the long incarceration.

On hearing the learned counsel for the Applicant, I find no justification to depart from my earlier observations, as the case against the Applicant is made out in the charge-sheet and sufficiency of the material has prompted me to reject the Application.
Merely because the trial would consume some time and though the learned counsel for the Applicant is conscious of the nature of accusations and the evidence in the charge-sheet, he vaguely attempt to suggest that the case of the Applicant may fall within Section 304 Part I of IPC, still definitely he would require to undergo sentence of ten years. By directing the Sessions Judge, Panvel to expedite the trial in Sessions Case No.16 of 2022, the Application is rejected.
