These applications were listed yesterday i.e. 19.09.2024 in the supplementary list, but they could not reach and hence, they are now to be listed on 26.09.2024 in the supplementary list. 3.
But, learned counsel for the applicants are seeking permission to withdraw these applications. Attention of this Court is invited to a recent
order dated 09.09.2024 passed by this Court (Coram : Revati Mohite Dere, J.) in bail application filed by co-accused person bearing Criminal Bail Application No.758 of 2023. It is submitted that in the light of the directions issued in the said order, this Court may permit the applicants to withdraw the present applications. A request is made for a direction to the prosecution as well as the defence not to seek any adjournments and for the concerned Court to ensure that the directions contained in the aforesaid order are strictly abided.

A perusal of the said order dated 09.09.2024 passed in Criminal Bail Application No.758 of 2023 shows that the following observations have been made.

Considering that the applicant is in custody for about 7 years and 2 months, the trial Court to dispose of the said case, as expeditiously as possible and in any event before 31st December, 2024. The learned trial Judge to take up the case, if necessary, on day-to-day basis, to complete the trial expeditiously.

We make it clear that the prosecution nor the defence counsel will not seek any adjournment. The accused shall also be produced before the Court either physically or through video-conferencing on the dates given by the trial Court. All parties to co-operate in the expeditious disposal of the trial. In the event, the trial is not concluded within the period as stated aforesaid, liberty is
granted to the applicant to file a fresh application before the trial Court, which shall be considered, on its merits, in accordance with law."

In view of the above, the applications are disposed of as withdrawn. All concerned parties and also the Trial Court are directed to abide by the above quoted directions issued by this Court. (MANISH PITALE, J.)
