When the application is called out for hearing, the learned APP informs this Court that charge-sheet will be filed tomorrow. She further submits that it would be appropriate if the application is considered upon the charge-sheet being filed, so that this Court can be assisted properly. Although, the learned counsel for the applicants was inclined to argue the application on merits, after some consideration, the learned counsel for the applicant, on instructions, submitted that if the charge-sheet is being filed tomorrow, liberty may be granted to the applicant to approach the Sessions Court afresh, upon filing of charge-sheet and in that context, permission may be granted to withdraw the present application.

In view of the above, the applicant is permitted to withdraw this application. Upon the charge-sheet being filed, which is likely to be filed tomorrow, liberty is reserved for the applicant to approach the Sessions Court for bail afresh.
