2. By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.40 of 2022, registered with Indapur Police Station, District: Pune Rural for the offences punishable under Sections 420, 403, 408, 409, 201, 120-B of the Indian Penal Code, Sections 5 and 6 of the Prize Chits and Money Circulation (Banning) Scheme Act, 1978, Sections 21, 22 and 23, 25 of the Banning of Unregulated Deposit Schemes Act, 2019.
3. This Court vide order dated 04/07/2024 in Criminal Bail Application No. 1771 of 2024 granted bail to one of the coaccused -Prashant Kumbhar. The case of the applicant is similar with the case of the co-accused, who has been granted bail. Thus, I am of the opinion that the principle of parity is applicable to the present applicant.
4. In the circumstances, though the application is opposed by the learned APP, on the ground of parity the applicant is entitled for bail.
5. Accordingly, I pass the following order:
i) The Criminal Application is allowed.
ii) It is directed that the applicant shall be released on bail in connection with Crime No.40 of 2022, registered with Indapur Police Station, District: Pune Rural for the offences punishable under Sections 420, 403, 408, 409, 201, 120-B of the Indian Penal Code, Sections 5 and 6 of the Prize Chits and Money Circulation (Banning) Scheme Act, 1978, Sections 21, 22 and 23, 25 of the Banning of Unregulated Deposit Schemes Act, 2019, on furnishing P.R.Bond in the sum of Rupees Twenty Five Thousand with one solvent surety in the like amount;
iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence;
iv) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence or breaches any condition for grant of bail.
v) The applicant shall attend the trial before the trial Court regularly on every date unless exemption is granted by the trial Court.
The Criminal Application is disposed of accordingly. (ANIL S. KILOR, J)
