By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.80 of 2024 registered with Mohol Police Station, District Solapur, for the offences punishable under Sections 20, 22, 8(c), 20(b)(2) of Indian Penal Code r/w Section 65(f) of Bombay Prohibition Act. 3.
Having gone through the charge sheet and the relevant material collected by the Investigating Officer during investigation it is evident that contraband i.e. Ganja which was recovered from the Applicant, is of intermediate quantity. Applicant is a lady aged 64 years of age. There are no antecedents against Applicant. MANISH SURESHRAO THATTE Date: 2024.10.21 18:03:23 +0530 4.
Thus, considering the nature of allegations against Applicant MANISH SURESHRAO THATTE and material collected by the Investigation during investigation against Applicant, and further the fact that charge sheet is filed, I am
2 of 2 17.BA.2920.2024.doc of the opinion that further custody of the Applicant is not required. Though learned APP is strongly opposing the application, I am of the opinion that the application needs to be allowed. Hence, I pass following order :
ORDER
(i) Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.80 of 2024 registered with Mohol Police Station, District Solapur, for the offences punishable under Sections 20, 22, 8(c), 20(b)(2) of Indian Penal Code r/w Section 65(f) of Bombay Prohibition Act on furnishing P.R.Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount; (iii) The Applicant shall attend Mohol Police Station, District Solapur, on every 1st and 16th of every month between 10.00 a.m and 11.00 a.m till conclusion of trial;
(iv) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; (v) Liberty is granted to the State for cancellation of bail if the applicant breaches any condition or misuses the liberty or commits similar offence;
(vi) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
