Heard Mr. Gandhi, learned Advocate for Applicant and Mr. Karmakar, learned APP for Respondent No.1- State. 3.
Mr. Gandhi, learned Advocate for Applicant states that he requires leave of the Court to convert the present Bail Application into a Criminal Appeal and lodge the same in this Court considering the challenge maintained in the present Application. 4.
He would submit that if the said leave is granted by the Court, Advocate for Applicant is willing to carry out the appropriate amendment and re-lodge the Application as Criminal Appeal. Leave to carry out the appropriate amendment is granted by the Court. Amendment to convert the present Bail Application into a Criminal
51.BA.3038.24.doc Appeal shall be carried out within a period of two weeks from today. Re-verification stands dispensed with.

After the amendment is carried out, Registry is directed by the Court to register the proceedings as Criminal Appeal by assigning a new lodging / registration number in accordance with law. Thereafter the same can be placed before the appropriate Court as per the roster assignment.

In view of the above directions, present Bail Application is therefore disposed.
