Mr. Bidkar, learned Advocate for Applicant would submit that Applicant is apprehended with 640 bottles of the alleged contraband which is cough syrup. He would submit that at page No.168 of the Application the mention of the notification is appended by the manufacturer of the said cough syrup stating that it is not a 'manufactured drug' or 'narcotic drug as qualified under the Narcotics Drugs and Psychotropic Substances Act, 1985 (for short "NDPS Act"). The said notification is issued under standing order 826(E) under Section 2(xi) of the NDPS Act and is dated 14.11.1985.

Ms Yadav, learned APP shall take cognizance of the aforesaid submissions made by Mr. Bidkar and apprise the Court on the veracity of the same on the next adjourned date. If Mr. Bidkar is right and the alleged contraband is not over under the NDPS Act then the benefit will be given to the Applicant.

Considering the Applicant is incarcerated for 1 year and 6 months, list the Bail Application on Board on 25th March, 2025. To be placed on the 'Supplementary Board'.
