By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.546 of 2023, registered with Rajarampuri Police Station, Kolhapur for the offences punishable under Sections 302 and 307 of the Indian Penal Code.

The learned counsel for the applicant states that no weapon used by the applicant and there was no intention to kill the deceased. However, going through the charge-sheet and the relevant material collected by the IO during the investigation, it is evident that varsha

916-ba-3125-2024.doc there is no sufficient incriminating material available on record to show the involvement of the applicant in the alleged offence. The applicant assaulted the deceased by wooden stick and the death was caused because of the head injury. The offence is serious. 4.

Thus, considering the nature of evidence and the nature of allegations against the applicant, I am of the opinion that the applicant is not entitled for grant of bail. Accordingly, it is rejected. (ANIL S. KILOR, J) varsha
