By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.46 of 2024, registered with Alandi Police Station, Pimpri Chinchwad, for the offences punishable under Sections 302, 201, 120-B r/w. 34 of the Indian Penal Code.

The offence is very serious and the IO has collected the sufficient incriminating material against the applicant to show that he along with co-accused person committed murder of the deceased. varsha

Though the learned counsel for the applicant tries to canvass before this Court that the CDR does not support the case of the prosecution as the CDR does not show that the applicant was present on the spot at the relevant time. However, after going through the CDR there is no information for the span of 8 hours during which period the offence was committed.

It is informed that during the said period his mobile phone was switched off.

Thus, at this stage the said submission cannot be accepted since it would be a matter of trial.

Thus, considering the nature of allegation against the applicant and the evidence collected by the IO during the investigation, I am of the opinion that this is not a fit case for grant of bail. Accordingly, it is rejected.
