By this application under Section 483 of the Code of Criminal Procedure, the Applicant is seeking bail in Crime No.281 of 2024, registered with Baramati Taluka Police Station, District: Pune (Rural) for the offences punishable under Sections 118(1), 125(a), 115(2), 352, 351(2), 351(3), 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023.

The Applicant is the second husband of the informant and there are allegations of assault by the informant. The injuries by SUNNY ANKUSHRAO THOTE Date:

2024.09.20 17:20:48 +0530 SUNNY ANKUSHRAO THOTE stated in the injury certificate are of simple in nature. Thus, considering the fact that the investigation is almost completed, I am of the opinion that further custody of the Applicant is not necessary.

In the circumstances, the application is allowed.

ORDER

i.

Criminal Bail Application No.3187 of 2024 is allowed; ii.

It is directed that the Applicant shall be released on bail in Crime No.281 of 2024, registered with Baramati Police Station, District: Pune (Rural) for the offences punishable under Sections 118(1), 125(a), 115(2), 352, 351(2), 351(3), 3(5) of Bharatiya Nyaya Sanhita (BNS), 2023, on furnishing P.R. Bond of Rupees Twenty Five Thousand with one solvent surety in the like amount;

iii.

The Applicant shall not enter within the territorial jurisdiction of Baramati Police Station, District: Pune (Rural) till conclusion of trial except for attending trial; iv.

The Applicant shall provide the address of the near by Police Station which he shall attend on 1st of each month between 10:00 am to 12:00 noon till conclusion of trial; v.

The Applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence; vi.

Liberty is granted to the State for cancellation of bail if the Applicant commits similar offence;

vii. The Applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the Trial Court for any reason.

viii. Application stands disposed off, accordingly. (ANIL S. KILOR, J.)
