By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No. 293 of 2023, registered with Shirol Police Station, Dist: Kolhapur for the offences punishable under Section 307 and 302 of the Indian Penal Code.

The learned counsel for the applicant submits that the whole case is based on the circumstantial evidence and there is no eyewitness to the incident, he therefore, submits that as the charge-sheet has been filed, the applicant may be released on bail. varsha

On the other hand, the learned APP is strongly opposing the application and has pointed out the recovery of clothes having bloodstains from the applicant.

Having gone through the charge-sheet and the relevant material collected by the IO, it is evident that there is sufficient circumstantial evidence collected by the IO, during the investigation which shows the involvement of the applicant in the alleged offence. The recovery of clothes having bloodstains also indicate prima facie complicity of the applicant in the alleged offence. The offence is serious and the applicant has committed murder of his own mother, I am not inclined to grant bail. Accordingly, it is rejected. 6.

At the stage the learned counsel for the applicant seeks liberty to apply afresh on receipt of CA report or in case of change in circumstances.
