By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.13 of 2019 registered with Indira Nagar Police Station, Nashik, for the offences punishable under Sections 394, 396, 397, 120(B) of Indian Penal Code r/w Section 135 of Maharashtra Police Act r/w Section 4/25 of Arms Act r/w Sections 3(1), 3(2) and 3(4) of Maharashtra Control of Organized Crime Act, 1999.

Learned counsel for Applicant has drawn attention of this MANISH SURESHRAO THATTE Date: 2024.09.18 15:01:30 +0530 MANISH SURESHRAO THATTE Court to the order dated 15th July 2024 passed by Hon'ble Supreme Court of India in Special Leave to Appeal (Criminal) No.5092 of 2024 dismissing the special leave petition of the co-accused Vilas
2 of 2 6.BA.3262.2024.doc Raju Mirazkar and on considering the period of incarceration, directed the Trial Court to conclude the trial within a period of one year from the date of order of Hon'ble Supreme Court of India. The Hon'ble Supreme Court of India further grants liberty to renew the request for grant of bail, if trial is not concluded within the time fixed by Hon'ble Supreme Court of India.

In the above referred backdrop learned counsel for Applicant seeks permission to withdraw present application with similar liberty as granted by the Hon'ble Supreme Court of India to co-accused Vilas Mirazkar. In the circumstances, the application is disposed off as withdrawn with liberty to renew his request for bail, if trial is not concluded within one year as directed by Hon'ble Supreme Court of India vide order dated 15th July 2024.
