Heard Mr. Mishra, learned Advocate for Applicant and Mr. Pethe, learned APP for Respondent.

Applicant is indicted for offence punishable under Sections 392, 170, 34 of the Indian Penal Code, 1860 (for short 'IPC'), Sections 3 and 25 of Arms Act, 1959. In so far as the charges under the Arms Act, 1959 is concerned, admittedly Applicant possess licence for the weapon which was carried by him. That is evident from the record which is placed before the Court.

In so far issue of dacoity is concerned, the facts in the present case and reasons requiring the First Informant to improve the complaint after 5 days and state the alleged recovery of Rs.50,00,000/- when in the first instance First Informant had specifically stated that
907.BA.3264.2024.doc he was accosted and Rs.1,50,000/- lying with him alongwith some personal documents of his were taken by Applicant and his accomplice needs to be explained by prosecution.

Mr. Pethe, learned APP persuades the Court that he shall peruse the charge-sheet and accordingly explain the role of Applicant which would be evident prima facie from the record of the case. 5.
