The applicant's brother has filed an affidavit stating that Assistant Police Inspector (API) Mr. Kadam seized his mobile phone and cash. However, the mobile phone has neither been returned to the applicant nor shown in the charge sheet as seized item.

Mr. Kadam, API, to file his personal affidavit explaining his stand on the statement made by the applicant's brother in paragraph Nos.6 and 7 of his affidavit.

Learned APP states that service has been effected on the victim. Since the victim has sought legal assistance, Mr. Viral Mukte, learned advocate, is appointed to represent the victim. 4.
