By this application under Section 439 of the Code of Criminal Procedure the applicant is seeking bail in Crime No.467 of 2024, registered with Panvel City Police Station, Raigad for the offences punishable under Sections 376, 354-A, 323, 504, 506 r/w. 34 of the Indian Penal Code.

The allegations against the applicat except the allegation that he asked for sexual favour from the complainant, there are no other allegations attracting the provisions of sections 376, 323, 504 and 506 of IPC. It is pertinent to note that the applicant is in jail from last 1
month and As far as the section 354-A, IPC, it is bailable. 4.
In the circumstances, after considering the allegations against the applicant, prima facie, it appears that except section 354-A, none of other offences would attract in the present matter against the applicant, I am of the opinion that the applicant is entitled for grant of bail.

In the circumstances, since the applicant is not the main accused and considering the allegation against the applicant as observed hereinabove, the application is allowed as further custody of the applicant is not necessary. Accordingly, I pass the following order:
ORDER
(i) Criminal Bail Application is allowed and disposed off; (ii) It is directed that the applicant shall be released on bail in Crime No.467 of 2024, registered with Panvel City Police Station, Raigad for the offences punishable under Sections 376, 354-A, 323, 504, 506 r/w. 34 of the Indian Penal Code, on furnishing P.R.Bond of Rupees Fifty Thousand with one solvent surety in the like amount;
iii) The applicant shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case, as also not tamper with the evidence;
iv) Liberty is granted to the State for cancellation of bail if the applicant commits similar offence;
v) The applicant shall attend the trial before the Trial Court regularly on every date unless exempted by the trial Court for any reason.
