This is an application for regular bail.

The applicant came to be arrested in Crime No.131 of 2022 registered at Shahuwadi Police Station, Kolhapur for the offence punishable under Sections 302 and 201 of the Indian Penal Code. 3.

The deceased was the husband of the present applicant. It is alleged that on the date of incident, which took place on 15.05.2022, a quarrel took place between the deceased and the applicant on account of alleged extramarital affair of the applicant and during the said quarrel it is alleged that the present applicant assaulted the deceased and thereafter strangulated him. 4.

I have heard the learned counsel for the applicant and the learned APP for the respondent - State.

The case is based on circumstantial evidence. The applicant is in jail for more than 1 & 1⁄2 years. The trial is still at the stage of framing of charge. The applicant has minor son. In that view of the matter, I am inclined to release the applicant on bail. In the result, the following order is passed.

O R D E R

A] The Application is allowed.

B] The applicant be released on bail in C.R. No.131 of 2022 registered at Shahuwadi Police Station, Kolhapur for the offence punishable under Sections 302 and 201 of the Indian Penal Code on furnishing P.R Bond in the sum of Rs.25,000/- (Rupees Twenty Five Thousand) with one or two sureties in the like amount.
