Heard Ms. Bhandarkar, learned Advocate for the Applicant; Mr. Kulkarni, learned APP for the State and Ms. Warunjikar, learned appointed Advocate for the Respondent No.2.

After expressing my disinclination to grant the present application, Ms. Bhandarkar, learned Advocate for the Applicant, on instructions, would submit that in the event, if the Court is not inclined to consider the advanced age of 68 years of the Applicant and various medical ailments besieging him while in incarceration, the trial be expedited. That undoubtedly is a fair request made by the learned Advocate which deserves consideration especially in view of the advanced age of the Applicant.

3. The trial is therefore directed by the Court to be completed as expeditiously as possible. In any event, it shall be open to the Applicant if the trial is not completed within a reasonable time to seek recourse to the Court for grant of bail.

Fees of the learned Advocate Ms. Warunjikar, appointed through legal aid to represent and espouse the cause of Respondent No. 2 shall be released by the Registry of this Court within a period of one week from the date of presentation of a server copy of this order on compliance.
