By the present Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 ("BNSS" for short), the Applicant is before this Court seeking regular bail in connection with Crime No. 130 of 2021 registered with Dattawadi Police Station, Pune for the offences punishable under Sections 302, 307, 143, 144, 147, 148, 149, 504, 506, 120(B) and 201 of the Indian Penal Code Act, 1860 ("IPC" for short), Sections 4 read with 25 of the Indian Arms Act, 1959, Section 7 of the Criminal Law Amendment Act, 2013 and Sections 37(1) read with 135 of the Gitalaxmi

Mr. Kuldeep Nikam, learned Advocate for the Applicant submits that he has instructions from the Applicant to withdraw the present Bail Application so as to file a fresh Bail Application in Sessions Case No. 665 of 2021, pending before the Additional Sessions Judge, Pune, in view of the liberty granted to the Applicant by this Court in its order dated 23rd April 2024 passed in Criminal Bail Application No. 999 of 2024. Hence, he seeks leave to withdraw the present Bail Application.

Mr. Pandurang Gaikwad, learned A.P.P. for the State/Respondent does not object for grant of such liberty in view of the order dated 23rd April 2024.

In view of the above, Applicant is at liberty to file a fresh Bail Application before the learned Trial Court. If such Application is filed by the Applicant before the learned Trial Court, then the same shall be considered on its own merits and in accordance with law. 6.
