This is an application for regular bail.

The applicant came to be arrested in Crime No. 33 of 2020, registered with Cyber Police Station, District : Pune, for the offences punishable under Sections 419, 420, 465, 467, 468, 471, 120(B) r/w Section 34 of Indian Penal Code and Sections 66(C) and 66(D) of the Information Technology Act, 2000 and Sections 14(A), 14(B) of the Foreigners Act, 1946. 3.
According to the prosecution the present applicant and other co-accused who are foreign nationals and came to India on false Passport and Visa contacted the complainant by SAJAKALI LIYAKAT JAMADAR Date:

R-13-BA-3543-2024.doc through online matrimonial website by creating fake profiles and duped her to the tune of Rs.12,19,949/-.

The learned counsel for the applicant submits that the applicant is in jail for three years and three months. It is submitted that the trial is still at the stage of framing of charge and not likely to be concluded in near future and thus the applicant may be released on bail.

On the other hand, learned A.P.P. for the RespondentState submits that the applicant came to India on fake Passport and Visa. It is submitted that it would be very difficult to secure the presence of the applicant, for trial if he absconds, after release. It is submitted that instead the trial may be expedited.

There is a substance in the submission of the learned A.P.P.. I am therefore not inclined to release the applicant on bail. The application is rejected.
