By these applications under Section 439 of the Code of Criminal Procedure the applicants are seeking temporary bail in Crime No.120 of 2024, registered with NRI Costal Police Station, District : Navi Mumbai for the offences punishable under Sections 307, 326, 324, 143, 144, 147, 148, 149, 354, 323, 504, 506, 201 and 452 of the Indian Penal Code.

The learned counsel for the applicants are seeking temporary bail on the ground that the mother of both the applicants is expired today.

The Death Certificate, dated 03/09/2024, tendered by them is taken on record and marked as "X" for identification. 5.
Earlier application was made for temporary bail on the ground that mother was seriously ill.

Considering the ground on which the bail is sought, I am of the opinion that the applicants are entitled for grant of bail. Hence, I pass the following order :
i) It is directed that both the applicants be released on temporary bail in Crime No.120 of 2024, registered with NRI Costal Police Station, District : Navi Mumbai for the offences punishable under Sections 307, 326, 324, 143, 144, 147, 148, 149, 354, 323, 504, 506, 201 and 452 of the Indian Penal Code on furnishing cash security of Rupees Twenty Five Thousand each, for the period of two weeks.
ii) In the meantime, the applicants shall attend the concerned Police Station on 8th to 10th September 2024 between 10:00 a.m. and 11:00 a.m.
iii) The applicants shall surrender before the Jail Authorities on 18th September 2024.
iv) The learned APP undertakes to communicate this order to the concerned Police Station to enable them to release the applicants from the custody of the Jail Authority.
v) The Jail Authority may take immediate steps to release the applicants.
The parties shall act upon the authenticated copy of this order.
