Heard Mr. Narayan Rokade, learned Advocate for the Applicant, Ms. Veera Shinde, learned APP for the State and Ms. Reena Prajapati, learned Advocate for the Respondent No.2. 2.
By the present application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, Applicant is seeking bail in connection with C. R. No.621 of 2019 registered with Bharati Vidyapith Police Station, Pune, for the offences punishable under Section 363, 366A, 376(N), 341, 506, of the Indian Penal Code, 1860 and Section 4, 5(l), 6 and 8 of the Protection of Children
from Sexual Offences Act, 2012. Said crime is registered as Special (POCSO) Case No.569 of 2019.

Mr. Narayan Rokade, learned Advocate for the Applicant submits that the Applicant is seeking bail on the ground of delay in completion of trial in. He submits that the said proceedings are of the year 2019 and still pending.

Ms. Veera Shinde, learned APP for the State, on instruction from the Investigation Officer, Mr. Anna Darade, Bharati Vidyapeeth Police Station, Pune, submits that last witness of the prosecution i.e. the Investigation Officer, is scheduled to be examined on 31.07.2025. She submits that the Investigation Officer would be examined on 31.07.2025 and his examination, subject to the cross-examination would be completed at the earliest. She submits that the trial in the said proceedings has reached the fag end. She submits that the said proceedings being of the year 2019, the same would be disposed off within a short span of time.

Ms. Reena Prajapati, learned Advocate for the Respondent No.2 submits that the victim, who was assaulted by the Applicant was 14 years of age at the time of incident. She submits that the trial is on the verge of completion, as the last witness of the prosecution i.e. Investigation Officer would be entering the witness box on 31.07.2025.

Mr. Narayan Rokade, learned Advocate for the Applicant submits that after the closure of the prosecution evidence, the Applicant intends to examine witness in support of his defense.

In view of the statements made by Ms. Veera Shinde, learned APP for the State in paragraph No.4 hereinabove, Mr. Rokade, learned Advocate for the Applicant, on instructions from the Applicant craves leave to withdraw the present application. He prays for a direction to the learned Trial Court to complete the trial within a stipulated time. Leave as prayed for is granted and Applicant is permitted to withdraw the present bail application. 8.
Considering the proceedings before the Trial Court are of the year 2019, the learned Trial Court to make an endeavor to dispose off the trial, expeditiously.

Mr. Narayan Rokade, learned Advocate for the Applicant, Ms. Veera Shinde, learned APP for the State and Ms. Reena Prajapati, learned Advocate for the Respondent No.2, submit that the parties would cooperate with the Trial Court in the early disposal of the trial.
