Heard the learned Counsel for the parties.

In view of the assertion made in the application that the bail application preferred by the applicant (Exhibit 208) in Special MCOC Case No.40 of 2020 was not decided by the learned Special Judge, MCOC Court, a report was called from the learned Special Judge, MCOC Court. 3.

The learned Special Judge has reported that the bail application has not been argued on behalf of the applicant and the prosecution. However, inadvertently it was recorded in the Roznama dated 10 May 2024 and 3 July 2024 that the bail application (Exhibit 208) was kept for passing orders. 4.

In view of the aforesaid report, learned Counsel for the Applicant seeks leave to withdraw the application. Learned Counsel for the Applicant, however, submits that the trial Court be directed to hear and decide the bail application within a time frame.

Ordinarily this Court would not have prescribed time frame for deciding the bail application. Yet in view of the fact that the report indicates that the bail application was heard on 7 March 2024, at least briefly, it may be appropriate to request the learned Special Judge, MCOC Court, to hear and decide bail application as expeditiously as possible and preferably on or before 20 December 2024.

The applicant and the prosecution shall not seek any adjournment for any reason whatsoever.

Application disposed as withdrawn.
