The Applicant-husband is seeking regular bail in an incident of assaulting his own wife with the help of knife. The offence is registered under Section 307 of Indian Penal Code. The incident is of 9th October 2022. There is no dispute that the charge is framed but recording of evidence is yet not started. Court has to balance the rights of both the parties. The right of speedy trial is being recognised but at the same time, the apprehension of prosecution about tampering with evidence of wife also needs to be considered. By way of via media the trial Court can be directed to record the

LSP 2 19 ba 3664.24.doc evidence of victim - first informant on priority basis. If the evidence is recorded, Applicant is at liberty to insist for grant of bail. 2.

Let it be recorded till 16th February 2026. Let this application be kept pending. Both the parties are at liberty to address this Court about the progress in the trial. Let the copy of this order be intimated to the trial Court and even both the sides can intimate the trial Court about this order.
