Heard Mr. Chopra, learned Advocate for Applicant and Mr. Dedhia, learned APP for Respondent - State.

In the present crime, Applicant is incarcerated for more than 7 years pending trial. Learned Advocate for Applicant informs the Court that trial has commenced and prosecution has examined only 2 out of 24 witnesses that they propose to examine in the trial as stated in the charge-sheet. He would persuade the Court to consider long incarceration of Applicant pending trial as the principal ground for grant of bail.

Mr. Dedhia, learned APP is directed to take appropriate instructions from the concerned Investigating Officer on the status of
32.BA.3753.24.doc trial and precise role of Applicant in the crime and accordingly apprise the Court on the next adjourned date on the veracity of the aforementioned submissions made by Mr. Chopra. Considering the long incarceration of more than 7 years, the Application shall be heard immediately.
