By the present application under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, Applicant is seeking bail in connection with C.R. No.91 of 2024 registered by the Shivaji Nagar Police Station, for the offences punishable under Sections 200, 419, 420, 467, 468, 471, read with Section 34 of the IPC. 3.
Case of the prosecution is that the stenographer working in the Court of JMFC, Court No.1, Lashkar Court, Pune, filed a complaint against the Applicant and three other accused persons. Applicant and other accused persons are involved in creating false
documents as also committing acts of forgery and tendering such documents before the Court, for furnishing the surety of the accused.

Accused is arrested in the said crime. Bail Application No.2963 of 2024 filed by the Applicant before the Court of the learned Additional Sessions Judge Pune was dismissed by the order dated 24.06.2024.

Ms. Anima Mishra, learned Advocate for the Applicant submits that the other accused (Accused No.3) by name Hemant Prashant Ikhankar, who is identically placed, has been released on bail by the Court of Additional Sessions Judge, Pune. She tenders the order dated 06.09.2024 passed in Criminal Bail Application No.4952 of 2024, same is taken on record and marked as "X-1" for identification. She submits that the role/ involvement of the Applicant in the present crime is of receiving documents from Accused No.3 and furnishing the same to Accused No.1. She submits that the Applicant is not involved in the crime. She relies on the following orders of this Court in the case of Deepak Hiralal Goplani Vs. State of Maharashtra1 and Shri Tarkeshwar Goraknath Pandey Vs. The State of Maharashtra2. She, therefore, prays for grant of bail.

Mr. Pandurang H. Gaikwad, learned APP for the State submits that the role and involvement of the Applicant is of creating false documents and tendering such documents in Court. He submits that the Courts to made to believe that such documents Criminal Application No.1817 of 2009, decided on 25.06.2009 Bail Application No.152 of 2011, decided on 18.02.2011
are genuine, when factually they are fabricated documents. He submits that the role of the Applicant in creation of false documents is specifically spelled out in the investigation carried out in the present crime. He submits that such act of the Applicant amounts to interference with the administration of justice. He submits that the Applicant has history of being involved in similar / identical crimes, such crimes being five in number. He has tendered the list of such crimes across the bar, the same is taken on record and marked as "X-2" for identification. He submits that the involvement / role of the Applicant is more serious than the involvement of the Accused No.3 as such there is no case of parity. He submits that trial in the case has been commenced. The complainant and witness in such trial has been examined. He submits that the offence in the facts and circumstances of the case is serious offence, against the society and as such, the Applicant would not be entitled to any indulgence.

I have perused the records with the able assistance of the learned Advocates for both the parties.

Material as placed before me indicates the modus operandi of the accused involved in the crime of creating false documents and using them as genuine. In the present case, such fabricated documents are used in Court of law. Role and involvement of the Applicant in creating false documents and using the same as genuine before the Court of law is revealed from the Investigation. Witnesses have implicated the Applicant in the present crime. The chart marked as "X-2" indicates the criminal antecedents of the Applicant.

In view of the above and the involvement as well as the participation of the Applicant in the crime is prima facie established. This is not a fit case for grant of bail. 10.
In view of the above, Bail Application No.3765 of 2024 is dismissed.
