Heard Mr. Sejpal, learned Advocate for Applicant and Ms. Bajoria, learned APP for State.

Present Application has been listed on Supplementary Board today in view of the long incarceration of Applicant who is arraigned as one of the accused in the crime in question. Applicant is arrested on 28.03.2018 and he is in prison for almost 7 years now. 3.

Mr. Sejpal would persuade the Court to consider the Application for release on bail of the Applicant on parity with other co-accused who have been released on bail by this Court, orders of which are appended to the Application. He would submit that role of the Applicant is similar to those that of the other accused who have been enlarged on bail and therefore Applicant deserves parity as also in view of the fact that out of 18 witnesses, witness action of 13

909. BA-3767-2024.docx witnesses is over and 5 more witnesses are yet to complete their witness action.

Ms. Bajoria, learned APP would persuade the Court to allow the prosecution to complete the trial and on taking instructions from the concerned Investigating Officer (IO) would submit that the trial would be completed by the end of April. She would also submit that role of the Applicant is not akin to the other accused who have been enlarged on bail considering that he is the main assailant. Be that as it may, learned APP shall inform the Court about precise role of the accused on the next adjourned date to enable the Court to form an opinion with respect to the present Bail Application. 5.

Stand over to 24th February, 2025. To be placed under the caption "First on Board".
