After having argued for some time and when this Court was not inclined to pass any positive order in favour of the applicant, the learned counsel for the applicant, on instructions, sought permission to withdraw the application, with prayer for appropriate directions for expeditious disposal of the trial. 2.
It was emphasized that the applicant was arrested on 1st September 2016, thereby showing that he has already suffered incarceration for a period of more than 8 years. 3.
The learned APP called for instructions and submitted that although, the list of witnesses filed along with the charge-sheet, shows that the prosecution would be examining 19 witnesses, but she has been specifically instructed to state that the prosecution would be actually examining 10 witnesses. It is further submitted
bipin prithiani 3-ba-3814.24.doc that 2 witnesses have been already examined and in that backdrop, it is submitted that the trial could be completed expeditiously. 4.
In view of the above, the application is disposed of as withdrawn.

The concerned trial Court is directed to expedite the trial and to make an endeavour to finish the same within 6 months from today.

This order be communicated immediately to the concerned trial Court.

The applicant is granted liberty to renew his prayer for bail, in the event, the trial is not completed within the said period and the delay is not attributable to him.
