Heard learned counsel for the applicant and learned APP for respondent-State.

Learned APP submitted that the Trial Court has issued nonbailable warrant against the absconding accused. Though non-bailable warrant was issued, the copy of order of issuance of non-bailable warrant was not served upon the concerned police station to execute the nonbailable warrant. Thereafter, the roznama shows that without cancelling the non-bailable warrant, the absconding accused appeared before the Trial Court.
