Heard the learned Counsel for the parties.

By an order dated 15th October, 2024, at the request of the applicant, the applicant was directed to be taken to Lilavati Hospital, Mumbai, for medical examination. The Court had further directed that, if the Medical Superintendent finds it necessary to admit the applicant as an indoor patient, the applicant be admitted therein and requisite treatment be provided. A report was directed to be submitted to the Court.

A report dated 21st October, 2024 is submitted by the Consultant attached to the Lilavati Hospital. 1/2

It is opined that having regard to the condition of the applicant, surgical intervention is not advisable at this stage. The applicant has been advised to have regular follow-up with chest physician and take some remedial measures and incorporate lifestyle changes.

In view of the aforesaid report, at this stage, the Court does not find any proprietary in entertaining the application for bail on medical grounds. If the health of the applicant deteriorates and the exigency of the situation so warrants, the applicant may revive the prayer for bail on medical grounds.

In the meanwhile the Superintendent Prison, shall take the applicant to Sir J. J. Group of Hospitals, Mumbai, for follow-up treatment as and when advised.
