Heard Mr. Mukte, learned Advocate for Applicant and Mr. Kulkarni, learned APP for State.

Mr. Mukte would submit that Applicant is a young offender aged about 19 years who in order to aid and assist accused No. 1 in the scuffle which ensued with the first informant - complainant admittedly used a knife to inflict a blow on the back of the first informant. He would submit that accused No. 3 inflicted a blow with a bamboo stick on the head of the first informant. On the issue of motive, he would submit that there was a verbal altercation between accused No. 1 and first informant on account of Rs. 1000/- between them which escalated and accused No. 1 summoned his friends i.e. accused Nos. 2 to 4 and they all joined accused No. 1 in assaulting the first informant.

BA-3838-24.docx He would persuade the Court to consider the medical certificate appended at page No. 69 of the Application which records that the injury suffered by the first informant on his back is simple injury. He would submit that other 3 accused are all enlarged on bail. He would therefore persuade the Court to consider parity, nature of injury being simple and the young age of the Applicant for grant of bail. On the issue of antecedents, he would submit that he will take appropriate instructions and inform the Court on the next date. 4.

Learned APP shall consider the aforesaid submissions made by Mr. Mukte and accordingly apprise the Court on the next adjourned date when the Application will be heard and decided by this Court. 5.

Stand over to 27th March, 2025.
