Heard Mr. Qureshi, learned Advocate for Applicant and Ms. Ganpathy, learned APP for Respondent - State of Maharashtra. 2.

This is an Application under Section 439 of Code of Criminal Procedure, 1973 (for short 'Cr.P.C.') seeking Bail in connection with C.R. No.193 of 2018 registered with Azad Maidan Police Station for offences punishable under Sections 302, 201 read with Sections 120-B, 34 of the Indian Penal Code, 1860 (for short 'IPC'). 3.

Ms. Ganpathy, learned APP would inform the Court that the trial has already commenced. By now 16 witnesses have already been examined and only 3 witnesses are yet to be examined. It is informed to the Court by Ms. Ganpathy, learned APP after obtaining specific

907.BA.3845.2024.doc instructions from the Investigating Officer present in Court and the prosecutor appearing before the Trial Court that witness action of the remaining three witnesses will be completed within a period of four months.

Considering the aforesaid position and gravity of crime in the present case, I am not inclined to grant the present Application. 5.

Needless to state that the prosecution shall complete examination of the remaining three witnesses as stated hereinabove and learned Trial Court shall determine the case as expeditiously as possible thereafter.

Bail Application is dismissed and disposed.
