By the present Bail Application, filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita (BNNS), the Applicant is seeking bail in connection with Cr. No. 1160/2027, registered with Chakan Police Station, for the offences punishable under Section 302, 201 of the Indian Penal Code. Said crime is registered as Sessions Case No.31/2018 and is pending on the file of the Additional Sessions Judge Khed-Rajgurunagar, Pune.

Case of the prosecution is that the Applicant committed murder of his wife. Deceased was gagged with swab of Odhani and
thereafter assaulted on her head with sickle. 4.
Applicant was arrested on 13th December, 2017. Since then, he is in jail.

First Bail Application at Exhibit-2 filed by the Applicant in Sessions Case No. 31/2018 was rejected by the learned Sessions Judge, Khed-Rajgurunagar, Pune on 26th July, 2018. Second Bail Application at Exhibit-11 in Sessions Case No. 31/2018 was rejected by the learned Sessions Judge, Khed-Rajgurunagar, Pune, on 8th June, 2021.

Mr. Chaitanya Purankar, learned advocate for the Applicant submits that the Applicant has instructed him to press the present bail Applicant on the ground of long incarceration. He submits that the Applicant does not press the Bail Application on merits. He relies on the orders of this Court in the case of Vikas Chandrakant Patil v/s. The State of Maharashtra1 and Niklesh Prakash Patil v/s. The State of Maharashtra2 in support of his contention for grant of bail on the ground of long incarceration.

Mr. T. G. Khan, learned APP for the Respondent-State submits that the subject matter of the present crime is a brutal murder Bail Application No. 1963 of 2025 decided on 9th May 2025. Bail Application No. 1208 of 2025 decided on 8th May 2025.
committed by the Applicant of his wife. He submits that the eye witness to the present crime is the son of the Applicant. He submits that the prosecution has examined 9 witnesses in the said crime. He submits that the matter is listed today (i.e. 3rd July, 2025) for the purpose of examining the Investigating Officer, who is the last witness of the prosecution. He submits that the trial in Sessions Case No. 31/2018 can be concluded within a short span, considering that the prosecution would be completing their evidence today, the offence being serious and witnessed by the son of the Applicant, the Applicant would not be entitled to bail on the ground of long incarceration. 8.
I have perused the records. Present crime was registered on 19th November, 2017. Proceedings are pending before the learned Additional Sessions Judge, Khed-Rajgurunagar, Pune since the year 2018. As submitted by Mr. Khan, learned APP for the RespondentState, the prosecution will be closing their evidence after examining the Investigating Officer. Mr. T. G. Khan submits that the examination of the Investigating Officer would be completed today positively. 9.
In view of the above said facts viz the Sessions case being pending from the year 2018, the prosecution completing their evidence positively by today, the son of the Applicant having deposed
in the present crime as eye witness, this is a fit case for issuing directions to the learned Additional Sessions Court, KhedRajgurunagar for completing the trial in Sessions Case No. 31/2018 within a period of two months from today.

This Bail Application No. 3914/2024 is disposed of with a direction to the learned Additional Sessions Judge, KhedRajgurunagar, Dist-Pune to conclude and disposed of the Trial in Sessions Case No. 31/2018 expeditiously and at any rate on or before the 30th August 2025. Both the parties assure the Court to co-operate in the early disposal of the said proceeding. 11.
Applicant and the Respondent are directed to place this order before the learned Additional Sessions Judge, KhedRajgurunagar. Mr. T. G. Khan, learned APP assures this Court that the direction issued today would be communicated to the learned APP appearing in Sessions Case No. 31/2018, so that the same can be brought to the notice of the learned Additional Sessions Judge, KhedRajgurunagar.
