By the present Application filed under section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short "BNSS"), the Applicant is seeking regular bail in Crime No. 317 of 2022 registered at Kavathe Mahakal Police Station, Sangli for the offences punishable under Section 302 read with 34 of the Indian Penal Code and Section 135 of the Maharashtra Police Act. 3.

Mrs. Veera Shinde, learned APP points out the order dated 8th October, 2023 passed by this Court in Bail Application No. 638 of 2023 and submits that the liberty granted by this Court Talwalkar

903.BA3950.2024.odt will have to be availed before the learned Trial Court, at the first instance.

Mr. Nikam, learned Advocate for the Applicant states on instructions that a fresh bail application will be filed before the learned Additional Sessions Judge, Sangli in terms of the liberty granted by the order dated 9th October, 2023. He states that such application will be filed in 10 days from today. Leave as prayed is granted.

In the event, any such application is filed before the learned Trial Court, the same be considered on its own merits and in accordance with law. In the facts of this case and considering the order dated 9th October, 2023, if such an application is filed, the learned Trail Court is requested to endeavour to dispose of the same expeditiously.

In view of the above, Criminal Bail Application No. 3950 of 2024 is dismissed as withdrawn with liberty as above. (ASHWIN D. BHOBE, J.) Talwalkar
