Heard Mr. Prashant Pawar, learned Advocate for the Applicant and Ms. Anamika Malhotra, learned APP for the State. 2.

By the present Application, Applicant is seeking bail in Crime No. 116 of 2023 registered with the Cyber Police Station, Pune. 3.

Mr. Prashant Pawar, learned Advocate for the Applicant submits that this Bail Application was filed on 30th September, 2024. He submits that during the pendency of this Application, the Applicant has filed a fresh Bail Application before the Court of the Judicial Magistrate First Class, Pune. He submits that the said Bail Application has been rejected on 16th April, 2025. He submits that by inadvertence the said fact was not brought to the notice of this Court. He submits that in view of the rejection of the Bail Application filed by the Applicant at Exhibit95 in RCC No. 309 of 2024, the Applicant intends to withdraw the present Bail Application and file appropriate proceedings before the Gayatri Shimpi

909-BA-4008-2024.doc Sessions Court raising all the grounds available to the Applicant, including the grounds urged in the present Bail Application. 4.

Ms. Anamika Malhotra, learned APP for the State and Ms. Rekha Musale, learned Advocate for Respondent No.2 do not object to the request and the liberty sought by the Applicant. They submit that it would be appropriate for the Applicant to first approach the Sessions Court.

In view of the above, Applicant is permitted to withdraw the present Bail Application with liberty to file appropriate proceedings before the Sessions Court raising all grounds including the grounds raised in the present Application. If such Application is filed the Sessions Court shall consider the same on its own merits and in accordance with law.

Bail Application No. 4008 of 2024 is disposed of with the liberty as above.
