This is an application for regular bail.

The applicant came to be arrested in Crime No.136 of 2022 registered at NRI Sagari Police Station, Navi Mumabi, for the offences punishable under Sections 302, 307 and 34 of the Indian Penal Code (IPC).

I have heard the learned counsel for the applicant and learned A.P.P. for the Respondent-State.

The deceased was the sister of the present applicant.

It is alleged that in the intervening night of 25-05-2025 and 26-05-2025 the present applicant and co-accused, another brother of the deceased, came to the house of the deceased and committed her murder by strangulating her as she stopped providing financial assistance to them after the death of their mother.

The learned counsel for the applicant submits that case is based on circumstantial evidence. It is submitted that the applicant is in jail for more than three years. 6.

The learned A.P.P. for the Respondent-State submits that there is enough material to connect the applicant with the alleged crime.

Considering the fact that case is based on circumstantial evidence and as the applicant is in jail for more than three years, I am inclined to release him on bail.

ORDER

(i) Criminal Bail Application is allowed;

(ii) The applicant is directed to be released on bail in connection with Crime No.136 of 2022 registered at NRI Sagari Police Station, Navi Mumabi, for the offences

punishable under Sections 302, 307 and 34 of the IPC on executing P.R. Bond in the sum of Rs.25,000/- with one or two sureties in the like amount;

(iii) The applicant shall attend the concerned Police Station once in a month i.e. on first Saturday between 11:00 a.m. to 1:00 p.m. till conclusion of trial; (iv) Application stands disposed of accordingly.
