I have gone through the charge-sheet and the relevant material collected by the Investigating Officer during the investigation, it is difficult that there is an eye witness to the incident and it has come to the statement of disputed Kisan Chavan, the brother of the Applicant, who has seen the incidents. He has not only narrated the incident but also stated the specific role played by the Applicant. Furthermore, there is recovery of the blood stained clothes. Considering the sufficient 1/2

117-ba4028-24.doc ingredient material available on record and seriousness of the offence,I do not find this is a fit case for grant bail. Accordingly, the application is rejected and disposed of.

However, considering the period of incarceration of the Applicant, liberty is granted to apply after nine months, if there is any progress in the trial.
